Texas Law Ruled as Unconstitutional

This week Pro Choice groups in Texas breathed a sign of relief.

Judge Sam Sparks of Federal District Court in Austin declared the law that requires a doctor to show pregnant women images from the sonogram and the sounds of the fetal heartbeat violated the First Amendment rights of doctors.

Sparks ruled that doctors cannot be criminally charged if they do not comply with the laws provision requiring them to perform an ultrasound and then wait 24 hours before performing am abortion. Or the provision for women forced to travel more than 100 miles from the abortion clinic, have the sonogram at least two hours before the procedure.

"The act compels physicians to advance an ideological agenda with which they may not agree, regardless of any medical necessity, and irrespective of whether the pregnant women wish to listen," the judge said in an interview with Austin News Tuesday.

This decision did not sit well with current Texas Governor and White House Hopeful Rick Perry.

"This important sonogram legislation ensures that every Texas woman seeking an abortion has all the facts about the life she is carrying, and understands the devastating impact of such a life-changing decision," Perry said hoping that the legislation will pass on appeal.
